ONDA BOT Privacy Policy

1. Who is responsible

Chat ONDA (ONDA, the chat, the bot) is a service of Fundación Precisar (hereinafter, Precisar, we). This policy describes how we handle information when you use the chat on the web and, where applicable, through WhatsApp.

2. What data we collect and why

2.1 On the web version (website / precisar.net)

  • Content you send: text messages, links, images or audio that you write or attach in the chat.
  • Technical data: IP address, browser and device type, and usage data (for example, that the chat was opened or a message was sent), necessary for the service to function and for security.
  • Purpose: To handle your inquiries, generate responses with artificial intelligence (AI) and improve service quality. We do not use the content of your messages for advertising nor do we sell it to third parties.

2.2 On the WhatsApp version

  • Phone number associated with your WhatsApp account.
  • Content you send: text, audio, images or links that you send to ONDA's number via WhatsApp.
  • Message identifiers that Meta/WhatsApp and we use to deliver and process responses.
  • Purpose: To provide the same ONDA chat service via WhatsApp: answer your questions, process audio (transcription) or images when you send them, and return text or audio responses when the system allows.

3. Legal basis and consent

  • Performance of the service: processing is necessary to provide you with the chat and responses.
  • Consent: by using the chat (web or WhatsApp) you accept this policy. If you are a minor, a parent or guardian is advised to be aware of use of the service.
  • Where applicable (for example, Chile, Brazil or the EU), we may also rely on legitimate interest to improve the service and security, always within what is described here.

4. Who we share data with

Providers necessary for the service:

  • OpenAI: text and image processing and response generation (and, if used, voice).
  • Vercel (or other hosting provider): hosting of the web chat.
  • Meta / WhatsApp: when you use ONDA via WhatsApp, messages pass through Meta's infrastructure according to WhatsApp's Privacy Policy.

We do not sell or rent your personal data. We only share it to the extent necessary to offer the chat and comply with the law.

5. Data retention

Conversations: messages and responses are processed to generate the response at the time. We may retain technical or usage logs for a limited time necessary for security, debugging or legal compliance.

WhatsApp: identifiers and content you send via WhatsApp are processed according to this policy and Meta's terms; we do not retain your number for purposes other than the service.

You may ask us not to retain identifiable data beyond what is strictly necessary; in that case, contact us (see section 8).

6. Security

We apply technical and organizational measures to protect data (encrypted communication, limited access, sensitive variables in a secure environment). No system is infallible; if you detect an incident, we appreciate you letting us know.

7. Your rights

Depending on the law that applies to you (for example, Law 19.628 in Chile or LGPD in Brazil), you may have the right to:

  • Access the data we hold about you.
  • Rectification or update of inaccurate data.
  • Deletion of data when the law allows.
  • Restriction of or objection to certain processing.
  • Data portability, where applicable.

9. Changes

We may update this policy. Relevant changes will be indicated on the web (for example, on precisar.net or on the page where the chat is offered) with a new Last updated date. Continued use of the chat after those changes implies acceptance of the updated policy.

This policy applies to Chat ONDA offered by Fundación Precisar on the web and, where applicable, on WhatsApp.
