1. Introduction

This Privacy Policy and Personal Data Processing Policy (hereinafter, the "Privacy Policy") aims to inform participants in the citizen consultation "How do you get informed today?" (hereinafter, the "Consultation"), promoted by Fundación Democracia Abierta and its Precisar initiative (hereinafter, "DemocraTICa" or "we"), about how we collect, use, store, share and protect your personal data, in accordance with current Chilean legislation and international best practices in the field.

DemocraTICa is committed to respecting and protecting your privacy and personal data. This policy has been drafted in compliance with current Chilean regulations, Law No. 19,628 on Protection of Private Life (in its current version) and the new Law No. 21,719 on Personal Data Protection, which modernizes the legislation and aligns it with the highest international standards, such as the European Union's General Data Protection Regulation (GDPR).

3. What personal data do we collect?

Within the framework of the Consultation, we will collect the following categories of personal data:

3.1 Identification and Contact Data

Optionally, we may request data such as: email address; full name.

Purpose: Future communications about the study results or to invite you to participate in later stages of the project.

Important clarification: Your participation in the consultation is not conditional on providing this information. You may participate anonymously.

3.2 Sociodemographic Data

We will collect data such as: age (in ranges: 18-25, 26-35, 36-50, 51-65, 65+); gender (male, female, other, prefer not to specify); education level (primary, secondary, technical, university, postgraduate); municipality of residence; region of residence; studies (in general categories).

Protection: This data will be requested in ranges or in anonymized form to protect your identity. Information that would allow us to identify you directly will not be collected.

3.3 Data on Information Habits and Preferences

The Consultation focuses on questions about: how you get informed; which media you use (television, radio, print press, social networks, digital platforms, etc.); how often you get informed; which formats you prefer (text, video, audio, infographics, etc.); which topics interest you (politics, economy, technology, health, etc.).

3.4 Data on Media Literacy Skills and Needs

We will collect information about: your ability to verify information; your capacity to use technology; your understanding of news and data; your ability to identify disinformation (information integrity).

3.5 Opinions and Perceptions

We will ask for your opinion on: disinformation (information integrity) and its effects; artificial intelligence in the media; possible solutions to these phenomena; trust in different media outlets.

3.6 Sensitive Data

The Consultation may include questions about: your political or ideological opinions; your religious beliefs (if applicable); any other information considered sensitive under Law 21,719.

Special protection: Processing of this sensitive data will be carried out only with your explicit consent and with the strictest security measures. We will inform you clearly and prominently when a question involves this type of data, and you may choose not to answer without this affecting your participation in the consultation.

4. What do we use your personal data for?

The personal data we collect will be used exclusively for the following purposes:

4.1 Statistical Analysis

To generate aggregated and anonymized evidence on: information habits of citizens in Chile; information needs; perceptions of disinformation (information integrity) and media literacy.

Clarification: Analyses will always be presented in aggregated form, with no possibility of identifying individual participants.

4.2 Academic and Social Research

The results of the Consultation will be used for: report preparation; academic studies; scientific publications; contribution to knowledge about disinformation (information integrity) and media literacy.

4.3 Prototype and Solution Design

The information collected will serve as input for: co-design of new news formats; development of information platforms; creation of educational resources; development of information verification tools.

4.4 Public Policy Advocacy

The project's findings will be shared with: decision-makers; media outlets; civil society organizations; public agencies.

Objective: To promote public policies and practices that strengthen Chile's information ecosystem.

4.5 Communication and Outreach

If you have consented, we may use your email address to: send you information about project progress; share results and findings; invite you to participate in related future initiatives.

Right to withdraw consent: You may withdraw this consent at any time by contacting us.

4.6 Compliance with Legal Obligations

We may use your data to: comply with legal obligations; respond to requests from competent authorities; protect our legal rights.

5. Legal Bases for Processing Your Data

5.1 Free, Informed, Specific and Unambiguous Consent

Your participation in the Consultation is voluntary. When you start the survey, we will ask for your consent clearly and explicitly for the processing of your personal data, in accordance with the purposes described in this policy.

Characteristics of consent: free; informed; specific; unambiguous. For sensitive data: we will request additional explicit consent before collecting any data considered sensitive.

5.2 Legitimate Interest

We may process your data in anonymized and aggregated form for research and statistical purposes, within the project's legitimate interest of: generating knowledge for the public good; strengthening Chile's information ecosystem; contributing to informed public debate; improving media literacy.

Balancing of interests: This legitimate interest does not override your fundamental rights, and data is always processed in anonymized form when this legal basis is used.

6. With whom do we share your personal data?

DemocraTICa will not sell, rent or transfer your personal data to third parties for profit. Your data may only be shared in the following circumstances:

6.1 Research Team

The DemocraTICa team and its direct collaborators will have access to the data for project purposes, under strict confidentiality agreements that include: obligation to maintain secrecy; restriction of use to project purposes; prohibition of disclosure to third parties; penalties for non-compliance.

6.2 Strategic Partners

We may share aggregated and anonymized data with: civil society organizations; universities and research centers; media outlets; public agencies.

Condition: This data will always be shared in aggregated form, with no possibility of identifying individual participants.

6.3 Publications and Dissemination

Reports and publications derived from the project will present data in aggregated, statistical, anonymized form, with no possibility of identifying individual participants.

6.4 Legal Requirements

We may share your personal data if required by: current law; a decree or resolution; a court order.

Protection: In these cases, we will inform the data subject about the request, unless the law expressly prohibits it.

6.5 Service Providers

We may share data with service providers that help us operate (hosting, analytics, etc.), under contracts that guarantee: equivalent data protection; exclusive use for project purposes; confidentiality obligations.

7. How Long Do We Retain Your Data?

We will retain your personal data according to the schedule published on the original site: identification and contact data (3 years from last communication, secure deletion); sociodemographic data, information habits and opinions (5 years from collection, anonymization or deletion); sensitive data (3 years from collection, secure deletion); aggregated/anonymized data (indefinite for research).

Deletion procedure: data will be securely deleted using cryptographic methods; a deletion certificate will be generated; a record of deletions will be maintained. Where possible, data will be anonymized rather than deleted; anonymized data may be retained indefinitely for research.

8. What Are Your Rights and How Can You Exercise Them?

Under Law 21,719, you have the right to:

  • Rectification: correct inaccurate data. Subject: "Personal Data Rectification Request".
  • Erasure or cancellation: when there is no legal basis, deadlines expire, you withdraw consent or object to processing. Subject: "Personal Data Erasure Request".
  • Objection: object to specific processing. Subject: "Data Processing Objection Request".
  • Portability: request portability in structured format. Subject: "Personal Data Portability Request".
  • Withdrawal of consent: at any time. Subject: "Consent Withdrawal". Future processing will stop; data already lawfully processed will not be affected.

To exercise any of these rights, send a request to contacto@precisar.net with your full name, a copy of your ID, a clear description of what you are requesting and a signature (in case of physical submission). Acknowledgment of receipt within 2 business days; response within a maximum of 30 business days. You may appeal to the Personal Data Protection Agency if you are not satisfied.

APDP contact: website, email and phone will be provided when the APDP is operational. Deadline for filing a complaint: within 1 year from when you become aware of the facts that motivate it.

10. Changes to This Privacy Policy

Fundación Democracia Abierta reserves the right to modify this Privacy Policy at any time. If you do not agree with significant changes, you may: withdraw your consent; request deletion of your data; contact us to discuss alternatives.

11.3 Jurisdiction: Any dispute related to this Policy will be resolved in accordance with the laws of the Republic of Chile and the jurisdiction of Chilean courts.
